Preliminary article
Supply and sale of YVONNE WASKA items on the website www.yvonnewaska.com website (hereinafter referred to as the “Website”), are governed by these general terms and conditions (hereinafter referred to as "GTC").
These General Terms and Conditions are concluded between, on the one hand, the YVONNE WASKA company, and, on the other hand, the Internet users willing to make a purchase as customers on the website (hereinafter referred to as " Customer(s)").
YVONNE WASKA is a Limited Liability Company (SARL) with a capital of 2.000 euros, registered with the Paris RCS under number 790 020 507, with head offices located at 43 rue Lucien Sampaix 75010 PARIS.
The website is hosted by the SITEPARC company, Limited Liability Company with a capital of 7.622 euros, registered with the Paris RCS under number 408 998 656, with head offices located at 3 rue Blomet, 75015 PARIS.
These General Terms and Conditions are intended to clarify the rights and obligations of the Customer and the Seller YVONNE WASKA (hereinafter referred to as "the Parties"). In the event of any effective order, the Parties agree that their relationship will be exclusively governed by these GTC and the purchasing order, to the exclusion of any other condition. Thus any order duly validated on the www.yvonnewaska.fr website implies full and unreserved acceptance of these Terms.
YVONNE WASKA reserves the right to unilaterally modify its Terms and Conditions at any time. The Customer can only be bound to the general terms and conditions in force when the order is placed.
Article 1 / Scope
These GTC are applicable to all sales of YVONNE WASKA items concluded on the e-shop accessible on the website www.yvonnewaska.com for deliveries to France (including Corsica, Overseas Departments and Territories), Germany, Belgium, Spain, Greece, Ireland, Italy, Luxembourg, the Netherlands, Portugal, the United Kingdom, Switzerland, Andorra and Monaco. For any additional information or complaint, the Customer could get in touch with customer services by email at contact@yvonnewaska.com
Article 2 / Product availability
Items offered for sale are those listed on the website the day the Customer placed his order, while stocks last. However, if the ordered item is unavailable while the order has already been placed, YVONNE WASKA will do its best to let the Customer know as soon as possible by email. The Customer could decide whether to change or cancel the order. In the latter case, the Customer will get a refund no later than thirty (30) days after his online payment.
Article 3 / Order terms
Customers willing to purchase any YVONNE WASKA item will follow the following route:
- Step 1: Type www.yvonnewaska.com and follow the website instructions
- Step 2: Go to a product’s page and add it to cart;
- Step 3: Confirm your order (approve the GTC) in the basket giving prices with all taxes included
- Step 4: In the payment section, if you are not already a customer, proceed to the creation of a personal account (with your first and last name, postal address, email address and password), otherwise sign in if you didn’t opt for the automatic identification
- Step 5: Pay for the order by filling in your bank details or using PayPal;
- Step 6: Receive an email with your order confirmation
- Step 7: Receive an email letting you know you order is being prepared and shipped
Article 4 / Order validation
Confirming his order, the Customer declares he is accepting his order without any reserve as well as these GTCs in its entirety. Data recorded by YVONNE WASKA are the proof of all transactions made between YVONNE WASKA and its Customers. Data recorded by the system of payment are proof of financial transactions.
Article 5 / Pricing and billing
Prices given on the website www.yvonnewaska.com are shown per item and include all taxes except shipping costs. When the order is being confirmed, the price the Customer has to pay is an all-inclusive price, including the prices of all items in the order plus shipping costs. YVONNE WASKA reserves the right to modify items’ prices. However, no modification can be applied to the Customer subsequently to taking the order.
The commercial invoice is sent to the Customer by electronic mail as an order confirmation. This invoice includes all the order information, the Customer details, as well as an order number.
Article 6 / Payment and security
Payment for purchases and participation to shipping costs are done only in euros, with Paypal or with a Credit Card among these: CB, Visa, EuroCard/MasterCard
- Payment with Paypal :
The customer must have a Paypal personal account in order to pay for his order with this payment method. If paying through Paypal, Paypal General Terms and Conditions will apply.
- Payment with a credit card:
According to Article L. 132-2 of the Monetary and Financial Code, committing to pay with a credit card makes payment irrevocable. By communicating his debit card number and all information listed below, the Customer authorizes the company YVONNE WASKA to debit his bank card the total amount of the order including taxes and delivery fees.
This payment will be carried out through the secure service of our partner INGENICO, a secure payment operator. In this way, no banking information about the Customer passes through YVONNE WASKA website and the payment remains secure. YVONNE WASKA does not keep any record of bank details or debit card number.
The Customer confirms that he is the holder of the credit card to be debited, that his name is written on that same card, then gives the 16 (sixteen) digit number and the expiration date from the front of the card, and the visual cryptogram numbers from the back of the card.
The order validated by the Customer will be considered final when the Customer's bank payment center will validate the transaction. In case of refusal of said centers, the order will be automatically canceled and the Customer will be notified by email. In case of acceptance, the Customer's account will be debited within 3 (three) days following the final validation of the order by the Customer.
Through its secure area, INGENICO is the only one to have knowledge of the Customer's banking information. This information does not pass through YVONNE WASKA website in any way.
INGENICO payment interface uses 3D secure technology. This is a system developed by Visa and MasterCard to authenticate the holders of debit/credit cards and thus prevents any fraudulent use. In addition to the number, validity date and cryptogram of the debit card that are provided, the customer is automatically redirected on one of his bank interface where he must authenticate himself. With the 3D Secure system the card holder must enter a personal information or a code sent to him by his bank beforehand. Once authenticated, the holder will see his transaction either authorized or refused by his bank.
Article 7/ Delivery
While ordering, first the customer must select the country of delivery among the following: Metropolitan France (including Corsica), Germany, Austria, Belgium, Spain, Ireland, Italy, Luxembourg, Netherlands, Portugal, Great-Britain, Switzerland, Monaco, Andorra.
He must then choose one of the delivery options offered by the website.
- Metropolitan France (including Corsica), Monaco and Andorra:
- Pick up in store - FREE
- Home delivery service with a bike courier in 1 working day * (Paris only) - FREE for any order over € 100, € 5 for any order under € 100
- Home delivery service with COLISSIMO postal service in 1-3 working days * - FREE for any order over 100 €, 5 € for any order under 100 €
- Europe and Overseas:
Home delivery with COLISSIMO postal services in 3-8 working days * - 10 €
* Shipping times imply the order is being processed by our team first.
The Customer receives a shipping confirmation email and can track his package on the carrier website using the tracking number provided in the email.
It is the Customer's own responsibility to check packages on arrival, to make any reservations or complaints that appear justified, or even to refuse the package if it is likely to have been opened or bears clear traces of deterioration. Said reservations and complaints must be sent to the carrier by registered letter with acknowledgment of receipt within 3 working days (public holidays not included) following the delivery of the order. According to the provisions of Article L 133-3 of the Commercial Code, failure to make a complaint within the aforementioned time limits will prevent any action against the carrier.
In the event of non-compliance, the Customer must inform YVONNE WASKA by email on the following address: contact@yvonnewaska.com, and return the items to the address indicated under article 9.
Article 8 / Right of withdrawal
Pursuant to article L. 121-20 of the Consumer Code, the Customer may return the items delivered within 15 (fifteen) days following the delivery date, without having to justify any reasons, in their original packaging. The returned package must be complete (accessories, instructions, pouches, etc.), items must be labeled, new, unworn, unwashed, and accompanied by the return slip that must be carefully completed and found on the customer account, along with a copy of the delivery slip, at the following address:

To simplify the exercise of the right of withdrawal, The Customer may send a pre-filled message from his customer account to inform YVONNE WASKA of his decision to withdraw. The products will not be refunded or exchanged beyond 15 (fifteen) days or if they are returned incomplete, spoiled, damaged, deteriorated or soiled by the Customer.
Return costs are at the charge of the Customer and associated risks are his responsibility. He should therefore provide proof of this return and return the products by registered mail, or by any other means providing a certain date of return. When the right of withdrawal is exercised, YVONNE WASKA will reimburse the Customer, within 30 (thirty) days from the day of withdrawal, and for the full price invoiced (initial delivery costs included). Refund will be made by bank transfer to the credit/debit card used by the Customer to order. In case of partial exercise of the right of withdrawal, relating to only part of the products subjected to the same order and delivery, YVONNE WASKA will proceed to a proportional partial refund.
Article 9 / Guarantees and after sales service
YVONNE WASKA agrees to exchange YVONNE WASKA products that do not match with the Customer's order (default or non-compliance). The Customer should by any means inform YVONNE WASKA and return the involved product(s) in perfect condition, complete (accessories, instructions, warranty, etc.), in its original packaging and along with a return slip. YVONNE WASKA will then proceed to exchange the product(s).

In the event of delivery of a defective item, or an item that does not comply with the order placed, return costs will be reimbursed. However, the amount to be refunded for return costs may not exceed 1.5 times (one and a half times) the amount of shipping costs invoiced. The dispatch of the new product will be made within a maximum of 15 (fifteen) days upon receipt of the defective or non-compliant YVONNE WASKA products. The refund of return costs will be credited on the bank account of the Customer who placed the order and on his billing address.
No cash on delivery will be accepted, whatever the reason.
In the absence of a possible exchange of the returned product, the total price invoiced (price of non-compliant products and shipping costs) as well as the return costs will be refunded, by crediting the credit/debit card used by the customer to pay for his order, at the latest within 30 (thirty) days upon receipt of returned products by YVONNE WASKA.
Article 10 / Personal data
YVONNE WASKA undertakes to ensure that the collection and processing of personal information is to be carried out within this website in accordance with law n ° 78-17 of January 6, 1978 as amended relating to data, files and freedoms known as the Law “Informatique et Libertés” or “Data Protection Act”.
This database has been declared, in accordance with the requirements of the law on information, files and freedoms of 6 January 1978 as amended under number 1760356.
The information entered by customers of the website may be subjected to computer processing by YVONNE WASKA. As such, website customers have the right to access, modify, rectify and delete data about concerning (article 40 of the amended Law "Informatique et Libertés"). Postal charges can be reimbursed on request on the basis of the slow rate in force. Depending on the choices made when creating or browsing their personal account, customers will be likely to choose whether or not they wish to receive YVONNE WASKA brand offers.
Article 11 / Intellectual property
All content and more generally all elements communicated or available on the website (images, texts, videos, sounds, etc.), excluding content provided by Customers, are YVONNE WASKA’s exclusive property or are used by YVONNE WASKA with the specific permission of the holder of the copyright and/or trademark rights involved.
These elements may not be reproduced, used or represented without the specific permission of YVONNE WASKA or third party owners. The Customer acknowledges and accepts that any violation of copyright, trademark or any other intellectual property rights is punishable by civil and/or criminal penalties.
Article 12 / Liability, force majeure and disputes
All products benefit from the legal guarantee of conformity (articles L. 211-1 and following of the Consumer Code) and from the guarantee against hidden defects (articles 1641 and following of the Civil Code), allowing the Customer to return delivered products that are defective or non-compliant.
Article L. 211-4 of the Consumer Code: the seller is required to deliver goods in compliance with the contract and is liable for any conformity defect existing at the time of delivery. The seller is also liable for any lack of conformity that comes with the packaging, the assembly instructions or the installation when the contract puts him in charge of it or when it has been carried out under its responsibility.
Article L. 211-5 of the Consumer Code: To comply with the contract, the goods must:
1 ° Be suitable for the use that is usually expected of a similar good and, where applicable:
- correspond to the description given by the seller and have the qualities that the latter presented to the buyer in the form of a sample or style;
- present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labeling;
2 ° Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Article L. 211-12 of the Consumer Code: Action undertaken for a lack of conformity lapses two years after delivery of the goods.
Article 1641 of the Civil Code: The seller is bound by the guarantee against hidden defects in the item sold, if this item is unfit for the use it was intended for, or if the use is reduced so much that the buyer would not have acquired it or would have given a lower price only, if he had known them.
Article 1648 of the Civil Code: The action resulting from prohibitive defects must be brought by the buyer within two years from the day the defect was discovered.
In the case provided for by article 1642-1, the action must be brought, on pain of foreclosure, within one year from the date on which the seller can be released from apparent defects or lack of conformity.
In the event that a Customer receive a product that does not comply with the order or reveals a hidden defect, the Customer may return said product to YVONNE WASKA under the conditions of Article 9.
YVONNE WASKA cannot be held liable for any breach of contractual obligations due to a fortuitous event or a case of force majeure; in the event of non-substantial differences between the images, texts and illustrations of the articles on our website and the articles ordered.
In the event of force majeure as defined below, the performance of YVONNE WASKA's services will be suspended for all or part. Force majeure means any unforeseeable and insurmountable event preventing YVONNE WASKA from meeting its contractual obligations. Force majeure includes but is not limited to the following cases: natural disasters such as war, riots, insurrection, social unrest, strikes of any kind and supply issues for the company YVONNE WASKA, but also and more generally, any circumstance that escapes the reasonable control of YVONNE WASKA.
In the event of the occurrence of an event qualified as force majeure according to the previous paragraph, YVONNE WASKA undertakes to notify the Customer as soon as possible.
Article 13 / Applicable law and competent judge
These GTC are subjected to French law.
In the event of any difficulty arising during the phase of order or delivery of YVONNE WASKA items, the Customer will have the possibility, before undertaking any legal action, to seek an amicable solution or any other advice, in particular with the help of a consumer association. Any dispute that may result from the interpretation or execution of these GTCs and this website will be subjected to the exclusive jurisdiction of French courts.
